Required documents for a Permission to employ foreign nationals for representative offices of foreign companies

In order to start the process of obtaining a Permission to employ foreign nationals a rep. office must be accredited in the Russian Federation by an authorized organization (State Register Chamber, Chamber of Commerce of the Russian Federation, etc.).

Stage I. Employment Center.

List of documents required for the Employment Center.

  1. Certificate on entry into the state registry - 1 copy;

  2. Notarially verified copy of a Certificate of a tax registration (giving a tax payer an identification number (INN) - 1 copy;

  3. Application-form - 1 copy;

  4. TN-1 Form "Information on need in employees" - 2 copies;

  5. Power of attorney for submission of documents to the Employment Center- 2 copies;

  6. Notarized copy of Goskomstat” letter (State Statistical Committee) – 1 copy;

Stage II. Federal Migration Service (FMS).

List of documents required for a Permission to employ foreign nationals

  1. Employer’s application executed to the name of deputy head of the FMS of Russia (in compliance with the decree of the FMS of Russia dated November 4, 2003 ? 20/6603) - 2 copies;

  2. Notarized copies of registration documents:

Copies of constituent documents of a parent enterprise. Copies must be translated into Russian and certified by a Notary.

  • It is necessary to submit documents containing the following information: date of registration of the company in the country of registration, registration number in the country of registration, document containing a legal address of a primary company;
  • Copy of a resolution to open a rep. Office, By-laws of a rep.office, and a Power of Attorney for Head of a rep. office;
  • Copies of documents issued by an accrediting body (Permit to open a rep. office, Certificate on entry into the state registry);
  • Notarially verified copy of a Certificate of a tax registration (giving a tax payer an identification number (INN);
  • Notarially verified copy of a license for carrying out of an activity (if such an activity is a subject to licensing);

3. Draft of a project of a labor contract that must include the following conditions: employer’s obligations to provide an employee with medical and social insurance, payment of labor in accordance with a staff list, the 40th working week and leave of not less than 28 calendar days (signed by a General Director and affixed with a seal) - 1 copy;

  1. The original document on payment of the state duty in the amount of 6 000 rubles for each employee. A live round seal of the bank is obligatory;

  2. Extract from a staff list specifying posts and wages of the employed persons (if employees’ salary is not mentioned in the labor contract– 1 copy;

  3. Power of Attorney for submission of documents to the FMS– 2 copies.

Stage III. Federal Migration Service (FMS)

List of documents for obtaining a work-permit in the FMS:

  1. Photography (colored, mat, 30 x 40 mm.) - 1 piece;

  2. Medical certificate confirming absence of infections (Certificate evidencing that an individual has no HIV-infection + certificate on absence of the diseases: tuberculosis, syphilis, leprosy (Hansen disease), Chlamydia lymph granuloma, chancroid, drug addiction). The Certificate is to be submitted when obtaining a work permit and valid within three moths;

  3. Application for the name of deputy director of the FMS of Russia - 2 copies;

  4. Copy of a Certificate (diploma) of professional education received by a foreign employee in a native or foreign country(must be translated into Russian and notarially verified)

  5. Copy of A Permission to employ foreign nationals(with submission of the original document);

  6. Payment order on paying the state duty (2000 rubles for each employee). A live round seal of the bank is obligatory;

  7. Letter of guarantee (seal and signatures of General Director and Chief Accountant are required);

  8. Document certifying the identity of a foreigner(passport or a document substituting it) (it must be translated into Russian and notarially verified) (must be not less than 6 months prior to expiration of validity) *

  9. Personal application on issuing a work-permit – 1 copy;

  10. Power of attorney for submission of documents in the FMS – 2 copies.

Working invitations and multiple working visas are issued by the body which accredited a rep. office of a foreign company in the Russian Federation.

* passport validity period must be not less that 1,5 year from the moment of the commencement of validity of a work permit, since this is the necessary condition for obtaining a visa.
